Miguel Luna Perez v. Sturgis Public Schools et al, No. 21-887

Firm: Skadden, Arps, Slate, Meagher & Flom

Issue Area: Civil Rights

Case summary

Skadden represents Sturgis Public Schools in a lawsuit filed against it by Miguel Luna Perez, a former student. The school did not provide Mr. Perez a classroom aide who knew sign language, in violation of the Individuals with Disabilities Education Act (IDEA), the Americans with Disabilities Act (ADA), and other statutes. As a result, shortly before the end of his time in high school, the school district informed Mr. Perez's parents that he would not graduate. Skadden is arguing before the Supreme Court that Mr. Perez's lawsuit should be dismissed because he did not exhaust his administrative remedies.
